OzJet Application( UpdateOn 18 June 2008, the Delegate of the Commission issued Determination [2008] IASC 107 allocating 0.5 units of capacity on the route to OzJet. China and New ZealandQantas has applied to vary Determination [2004] IASC 101 on the China route and Determination [2006] IASC 109 on the New Zealand route, to permit code share services with China Eastern on Qantas services. Qantas has also applied to vary Determination [2004] IASC 101, removing provisions enabling Air China to code share on Qantas services. Submissions about the application are invited. Qantas Application( UpdateOn 4 June 2008, the Delegate of the Commission issued Decision [2008] IASC 210and [2008] IASC 211 permitting China Eastern to code share on Qantas services. JapanQantas has applied to the Commission for a variation to Determinations [2004] IASC 120, [2005] IASC 123, [2005] IASC 126, [2006] IASC 113, and [2006] IASC 117 to enable Japan Airlines to continue to code share on certain Qantas services on the Japan route. Qantas Application( UpdateOn 8 April 2008, the Delegate of the Commission issued Determination [2008] IASC 104, which allocates 1,029 seats per week of capacity in each direction on the route. United StatesQantas has applied for an allocation of unlimited passenger and cargo capacity as a result of recent changes to the air services agreements between Australia and the United States. Other applications are invited. Qantas Application( UpdateOn 2 April 2008, the Delegate of the Commission issued Determination [2008] IASC 103, which allocates unlimited passenger and cargo capacity to Qantas on the route. The Delegate of the Commission also issued Decision [2008] IASC 203, which revoked previous determinations. New ZealandOzJet Airlines have applied to the Commission for an allocation of unlimited capacity and frequency on the New Zealand route. Other applications for the capacity are invited. OzJet Application( UpdateOn 21 February 2008, the Delegate of the Commission issued interim Determination [2008] IASC 102 allocating unlimited passenger capacity in each direction on the New Zealand route for a period of three years. SwitzerlandQantas has applied to the Commission to vary Determination [2006] IASC 116 to enable Qantas to code share on daily British Airways services between London and Zurich. These services would connect with Qantas flights to Sydney via Bangkok. The Qantas application( UpdateOn 31 January 2008, the Delegate of the Commission issued Decision [2008] IASC 202, to permit British Airways to code share on Qantas services. IndonesiaOzJet has applied to the Commission for an allocation of 306 seats in each direction per week on the Indonesia route. Other applications for the capacity are invited. OzJet application( UpdateOn the 20 February 2008, the Commission issued Determination [2008] IASC 101, allocating the capacity to OzJet for a period of two years. Hong KongQantas has applied to vary Determination [2003] IASC 107 as renewed by Determination [2007] IASC 115, for an allocation of a fourth frequency on the Hong Kong route. Applications for the capacity or submissions about the application are invited. Qantas application( UpdateOn 15 January 2008, the Delegate of the Commission issued Decision [2008] IASC 201 varying the Determinations to add a fourth frequency on the route. Papua New GuineaHeavyLift has applied for an additional 45 tonnes of freight capacity per week on the PNG route. Other applications for the capacity are invited. HeavyLift application( Update - 15 November 2007Qantas has notified it's intention to apply for 34 tonnes of capacity per week. A copy of Qantas' letter of intention can be found here. ( Following receipt of the Qantas intention to apply for capacity, HeavyLift has reduced the amount of capacity sought in its origional application from 45 tonnes to 26 tonnes per week. A copy of the HeavyLift letter can be found here. ( Update - 27 November 2007On 22 November 2007, the Commission received an application from Qantas seeking 34 tonnes of freight capacity on the PNG route. The application may be found here. As the combined total of the two applications does not exceed the available capacity, this is not a contested case and therefore will be considered against paragraph 4 of the Ministers Policy Statement only. Update - 19 December 2007On 10 December 2007 the Commission issued Determinations [2007] IASC 122and [2007] IASC 123 allocating 26 tonnes of capacity to HeavyLift and 34 tonnes of capacity to Qantas. Singapore and GermanyQantas has applied to the Commission for a variation to Determination [2007] IASC 116 on the Singapore route and Determinations [2006] IASC 107 and [2002] IASC 126, as renewed by Determination [2007] IASC 105, on the Germany route. This would enable Iberia, a Spanish carrier, to code share on Qantas operated services between Sydney - Singapore - Frankfurt. Under the reciprocated arrangements, Qantas will code share on Iberia's daily services between Frankfurt and Madrid. Submissions about the variations are invited. Qantas application( UpdateOn 16 November 2007, the Commission issued Decisions [2007] IASC 214and [2007] IASC 215 varying the Determinations to permit Iberia Airlines to code share on Qantas servcies from Australia to Singapore and from Australia to Germany. Solomon IslandsPacific Blue has applied to the Commission for an allocation of 540 seats of capacity per week on the Solomon Islands route. Other applications for the capacity are invited. Pacific Blue application( Other ApplicationsOn 5 October 2007, Sky Air World( Update - 16 October 2007Sky Air World's application for capacity together with the capacity sought by Pacific Blue is expected to exceed the amount of capacity available for allocation on the route. As a result the case is now a contested one. Accordingly the Commission has written to both applicants inviting them to address the paragraph 5 criteria in the Ministers policy statement by COB 19 October. The Commission has also advertised on 17 October 2007, inviting submissions from interested parties about the two applications. The closing date for notifying an intention to make a submission is 24 October 2007 and to make the submission is 31 October 2007. Update - 17 October 2007An application for capacity was received from Sky Air World on 16 October 2007. The application may be viewed here( Submissions receivedBrisbane Airport Corporation Pty Ltd( Ministry of Culture & Tourism( Ministry of Communications, Aviation & Meteorology( 19 October 2007 - Paragraph 5 Submissions receivedSky Air World( Pacific Blue Australia( 19 October 2007 - Supplementary application for capacityAs part of its 19 October letter addressing the paragraph 5 criteria, Pacific Blue Australia modified its original application from 540 seats to 720 seats per week. See Pacific Blue Australia's paragraph 5 submission above for details. The application for the additional 180 seats was advertised on 24 October 2007. The closing date for other applications for this element of the capacity is 31 October 2007. 7 November 2007 - Letter from DOTARSDOTARS wrote on 6 November 2007, in response to a request from the Commission, advising that it considered Sky Air World to be reasonably capable of obtaining the approvals necessary to operate. 21 November 2007 - Draft DeterminationsThe Commission has issued draft determinations proposing to allocate capacity to both Sky Air World and Pacific Blue Australia on the Solomon Islands route. The decision is in response to competing applications from the two airlines for capacity on the route. A copy of the Commission's draft determinations may be viewed here. Submissions about the draft determinations are invited. Submissions must be received by no later than close of business on 27 November 2007. After consideration of any submissions, the Commission will issue its final determination/s as soon as possible. 28 November 2007 - Submissions on the Draft DeterminationThe Commission has received submissions from both Sky Air World and Pacific Blue about the Draft Determination. The submissions may be found below. Sky Air World( Pacific Blue( Update - 19 December 2007On 10 December 2007 the Commission issued final Determinations [2007] IASC 120and [2007] IASC 121 allocating 360 seats of capacity per week to Pacific Blue Australia and 470 seats of capacity per week to Sky Air World. IndonesiaThe IASC has received an application from Qantas to vary Determination [2003] IASC 203to permit seats to be sold under the Air France code on services between Denpasar and Sinagapore for the duration of the determination. Submissions about the application are invited. Qantas application( UpdateOn 11 October 2007, the Delegate of the Commission issued Decision [2007] IASC 211 permitting Air France to code share on Qantas services. Papua New GuineaThe IASC has received an application from Qantas Airways Limited (ACN 009 661 901) (Qantas) to vary Determination [2006] IASC 129 to enable Qantas to continue code sharing on Air Niugini services on the Papua New Guinea (PNG) route. The application is in two parts. The first part seeks short term authorisation for code sharing until 29 February 2008. If approved by the IASC, this will allow code sharing to continue while the IASC conducts in parallel with the PNG Independent Competition and Consumer Commission (ICCC) an in depth review of arrangements. The second part of the Qantas application seeks code share authorisation for the duration of the Determination (30 June 2012) in the context of that broader review by the two Commissions. Air Niugini has separately sought authorisation from the ICCC to continue the code sharing arrangements with Qantas. Submissions about the application are invited about the short and long term code share extensions. Qantas application The closing date for notice of intention to make a submission about either proposal is COB 25 May 2007. After notification of intention, submitters have a further five working days to make a full submission about the short term proposal and an additional five days to submit about the long-term proposal, unless additional time is sought and agreed to by the Commission. If no notice of intention is received by COB 25 May 2007, the Commission may proceed to decide the matters under consideration as soon as practicable after that date. UpdateOn 30 May 2007, the Commission issued Decision [2007] IASC 208, which permits Qantas to continue to code share on Air Nuigini services until 29 February 2008. Update 2 - 7 September 2007The Commission has made a draft decision proposing to authorise a continuation of code sharing by Qantas with Air Niugini on Air Niugini's services between Sydney, Brisbane, Cairns and Port Moresby. The proposed period of authorisation is until 31 December 2009. Submissions about the draft decision are invited. The closing date for the receipt of submission is COB 21 September 2007. Submissions RecievedQantas Airways Limited( UpdateOn 16 November 2007, the Commission concluded its review of the code share arrangements between Qantas and Air Niugini. The Commission's final decision may be found here. The decision authorises a continuation of the code share arrangements until 31 December 2009. PNG's Independent Consumer and Competition Commission has also issued its final decision authorising a continuation of the arrangements for the same period, with some slightly different conditions. Qantasand Pacific Blue Airlines applications were advertised on Thursday 6 September 2007. Applications are invited for any of the capacity allocated by the determinations for which renewal is sought. The closing date for of intention to apply is COB 13 September 2007. After notification of intention to apply applicants have a further five working days to make a full application unless additional time is sought and agreed by the Commission. If no notice of intention to apply is received by COB 13 September, the Commission may proceed to decide the matters under consideration as soon as practicable after that date. UpdateOn the 11 October 2007, the Delegate of the Commission renewed all of the determinations above. All of the renewal Determinations may be viewed under Determinations and Decisions on this site. Capiteq Limited, trading as Airnorth, applied to the Commission for a variation to an existing determination, which allocates unlimited capacity on the Indonesia route, to allow code sharing with Qantas on Airnorth's services between Darwin and Denpasar. Submissions about the application are invited. Airnorth's application is in two parts, part 1( UpdateOn 31 August 2007, the Commission issued Decision [2007] IASC 210 permitting Qantas to code share on Airnorth's services. Virgin Blue International Airlines (VBIA) have applied for an allocation of capacity on the South Pacific route. VBIA plans to operate ten B777-300 services per week from November 2008. To this end it has applied for capacity consistant with the terms of the Australia - United States air transport arrangements. Other applications are invited. VBIA application( UpdateOn 23 July 2007, the Commission issued Determination [2007] IASC 104 allocating capacity on the United States route to VBIA. Qantas has applied to vary Determination [2006] IASC 110. Qantas seeks an additional third country code share service per week to enable an expansion of code sharing with Mal?Hungarian Airlines on the Thailand route. Submissions about the application are invited. Qantas application( UpdateOn 13 June 2007, the Delegate of the Commission issued Decision [2007] IASC 209 enabling an expansion of Qantas' existing code share arrangements with Mal?Hungarian Airlines. Qantas has applied for an allocation of 825 seats per week in each direction on the China route and to enable Jetstar, a wholly owned subsiduary of Qantas, to code share on Qantas operated services. Further Update On 17 May 2007, the Commission issued Determination [2007] IASC 102 allocating 25 tonnes of freight capacity per week on the Solomon Islands route. Qantas has applied for an allocation of three third country code share services per week in each direction on the Thailand route and to vary Determination [2006] IASC 110 to enable Malev to code share on Qantas operated services. Update On the 29 January 2007, the Delegate of the Commission issued Decision [2007] IASC 202 which allocated an additional 36 seats per week in each direction on the Canada route.
