Cases currently before the Commission

Vanuatu, Fiji and Cook Islands

Pacific blue have applied for an allocation of 180 seats per week on the Vanuatu route, 360 seats per week on the Fiji route and 180 seats per week on the Cook Islands route.  Other applications for the capacity are invited.  Pacific Blue Application (Acrobat PDF 42KB), advertised on 24 July 2008.  The closing date for notice of intention to make an application is COB 31 July 2008, with applications due by COB 7 August 2008.


South Africa

V Australia have applied for an allocation of five weekly frequencies on the South Africa route.  Other applications for the capacity are invited.  V Australia Application (Acrobat PDF 36KB), advertised on 24 July 2008.  The closing date for notice of intention to make an application is COB 31 July 2008, with applications due by COB 7 August 2008.


United States

V Australia have applied for an allocation of unlimited passenger and cargo capacity and frequency on the United States route.  Other applications for the capacity are invited.  V Australia Application (Acrobat PDF 38KB), advertised on 24 July 2008.  The closing date for notice of intention to make an application is COB 31 July 2008, with applications due by COB 7 August 2008.


South Africa

Qantas have applied for an allocation of two frequencies per week on the South Africa route. Other applications are invited. Qantas Application(Acrobat PDF 56KB), advertised on the 4 July 2004. Notifications of intention to apply are to be received by 11 July 2008, with applications due by 18 July 2008.

Update

On 17 July 2008, the Commission issued Determination [2008] IASC 109, allocating two frequencies per week in each direction.


Vietnam

Qantas have applied for an allocation of two frequencies per week on the Vietnam route. Other applications for the capacity are invited. Qantas Application(Acrobat PDF57KB), advertised on the 11 June 2008. Notifications of intention to apply are to be received by 18 June 2008, with applications due by 25 June 2008.

Update

On 18 June 2008, the Delegate of the Commission issued Determination [2008] IASC 108 allocating two frequencies per week in each direction on the route to Qantas.


Nauru

OzJet have applied for an allocation of one B737 service per week on the Nauru route. Other applications for the capacity are invited. OzJet Application(Acrobat PDF269KB), advertised on the 11 June 2008. Notifications of intention to apply are to be received by 18 June 2008, with applications due by 25 June 2008.

Update 24 June 2008

On 18 June 2008, the Delegate of the Commission issued Determination [2008] IASC 106 allocating one frequency per week on the route to OzJet.


New Caledonia (France Route 3)

OzJet have applied for an allocation of 0.5 units of capacity to allow it to operate two B737 services per week on the New Caledonia (France Route 3) route. Other applications for the capacity are invited. OzJet Application(Acrobat PDF272KB), advertised on the 11 June 2008. Notifications of intention to apply are to be received by 18 June 2008, with applications due by 25 June 2008.

Update

On 18 June 2008, the Delegate of the Commission issued Determination [2008] IASC 107 allocating 0.5 units of capacity on the route to OzJet.


China and New Zealand

Qantas has applied to vary Determination [2004] IASC 101 on the China route and Determination [2006] IASC 109 on the New Zealand route, to permit code share services with China Eastern on Qantas services. Qantas has also applied to vary Determination [2004] IASC 101, removing provisions enabling Air China to code share on Qantas services. Submissions about the application are invited. Qantas Application(Acrobat PDF 88KB) advertised on 22 May 2008. Notifications of intention are to be received by 29 May, with submissions due by COB 5 June 2008.

Update

On 4 June 2008, the Delegate of the Commission issued Decision [2008] IASC 210and [2008] IASC 211 permitting China Eastern to code share on Qantas services.


Japan

Qantas has applied to the Commission for a variation to Determinations [2004] IASC 120, [2005] IASC 123, [2005] IASC 126, [2006] IASC 113, and [2006] IASC 117 to enable Japan Airlines to continue to code share on certain Qantas services on the Japan route. Submissions about the application are invited. Qantas Application(Acrobat PDF 315KB) advertised on 13 May 2008, with notice of intention to make a submission to be received by 20 May 2008. Submitters then have until 27 May 2008 to enter a submission.

Update

On 11 June 2008, Qantas revised the application, to seek extension of the current authorisations for a six month period. The revised application may be viewed here.

On 16 June 2008, the Commission issued Decision [2008] IASC 212 permitting an extension of the code share arrangements until 31 December 2008.


Papua New Guinea

Qantas has applied for a variation to Determination [2007] IASC 123, which allocates freight capacity on the route, to permit joint services with Qantas or any wholly-owned subsidiary of the Qantas Group. Submissions about the application are invited. Qantas Application(Acrobat PDF 37KB) advertised on 9 April 2008, with notice of intention to make a submission to be received by 16 April. Submitters then have until 23 April 2008 to enter a submission.

Update

On 17 April 2008, the Delegate of the Commission issued Decision [2008] IASC 204, varying Determination [2007] IASC 123 to permit joint services with Qantas and any wholly-owned subsidiary of the Qantas Group on the route.


Argentina

Qantas has applied to the Commission for an allocation of 1,029 seats per week of capacity on the Argentina route. Other applications are invited. Qantas Application(Acrobat PDF 60KB) advertised on 19 March 2008, with notice of intention to apply for capacity to be recieved by 26 March and application due by COB 2 April 2008.

Update

On 8 April 2008, the Delegate of the Commission issued Determination [2008] IASC 104, which allocates 1,029 seats per week of capacity in each direction on the route.


United States

Qantas has applied for an allocation of unlimited passenger and cargo capacity as a result of recent changes to the air services agreements between Australia and the United States. Other applications are invited. Qantas Application(Acrobat PDF 71KB) advertised on 27 February 2008, with notice of intention to apply for capacity to be received by 5 March 2008, and application due by COB 12 March 2008.

Update

On 2 April 2008, the Delegate of the Commission issued Determination [2008] IASC 103, which allocates unlimited passenger and cargo capacity to Qantas on the route. The Delegate of the Commission also issued Decision [2008] IASC 203, which revoked previous determinations.


New Zealand

OzJet Airlines have applied to the Commission for an allocation of unlimited capacity and frequency on the New Zealand route. Other applications for the capacity are invited. OzJet Application(Acrobat PDF 114 KB) advertised on 8 February 2008, with notice of intention to apply for capacity to be received by 15 February 2008, and application due by COB 22 February 2008.

Update

On 21 February 2008, the Delegate of the Commission issued interim Determination [2008] IASC 102 allocating unlimited passenger capacity in each direction on the New Zealand route for a period of three years.


Switzerland

Qantas has applied to the Commission to vary Determination [2006] IASC 116 to enable Qantas to code share on daily British Airways services between London and Zurich. These services would connect with Qantas flights to Sydney via Bangkok. The Qantas application(Acrobat PDF 69KB) advertised on 23 January 2008, with notice of intention to make a submission to be received by 30 January. Submitters then have until 6 February 2008 to enter a submission.

Update

On 31 January 2008, the Delegate of the Commission issued Decision [2008] IASC 202, to permit British Airways to code share on Qantas services.


Indonesia

OzJet has applied to the Commission for an allocation of 306 seats in each direction per week on the Indonesia route. Other applications for the capacity are invited. OzJet application(Acrobat PDF 213KB) advertised on 7 January 2008, with notice of intention to make an application to be received by COB 14 January 2008.

Update

On the 20 February 2008, the Commission issued Determination [2008] IASC 101, allocating the capacity to OzJet for a period of two years.


Hong Kong

Qantas has applied to vary Determination [2003] IASC 107 as renewed by Determination [2007] IASC 115, for an allocation of a fourth frequency on the Hong Kong route. Applications for the capacity or submissions about the application are invited. Qantas application(Acrobat PDF 48KB) advertised on 7 January 2008, with notice of intention to make a submission to be received by COB 14 January 2008.

Update

On 15 January 2008, the Delegate of the Commission issued Decision [2008] IASC 201 varying the Determinations to add a fourth frequency on the route.


Papua New Guinea

HeavyLift has applied for an additional 45 tonnes of freight capacity per week on the PNG route. Other applications for the capacity are invited. HeavyLift application(Acrobat PDF 30KB) advertised on 13 November 2007, with notice of intention to make an application to be received by COB 20 November 2007.

Update - 15 November 2007

Qantas has notified it's intention to apply for 34 tonnes of capacity per week. A copy of Qantas' letter of intention can be found here. (Acrobat PDF 57KB)

Following receipt of the Qantas intention to apply for capacity, HeavyLift has reduced the amount of capacity sought in its origional application from 45 tonnes to 26 tonnes per week. A copy of the HeavyLift letter can be found here. (Acrobat PDF 57KB)

Update - 27 November 2007

On 22 November 2007, the Commission received an application from Qantas seeking 34 tonnes of freight capacity on the PNG route. The application may be found here. As the combined total of the two applications does not exceed the available capacity, this is not a contested case and therefore will be considered against paragraph 4 of the Ministers Policy Statement only.

Update - 19 December 2007

On 10 December 2007 the Commission issued Determinations [2007] IASC 122and [2007] IASC 123 allocating 26 tonnes of capacity to HeavyLift and 34 tonnes of capacity to Qantas.


Singapore and Germany

Qantas has applied to the Commission for a variation to Determination [2007] IASC 116 on the Singapore route and Determinations [2006] IASC 107 and [2002] IASC 126, as renewed by Determination [2007] IASC 105, on the Germany route. This would enable Iberia, a Spanish carrier, to code share on Qantas operated services between Sydney - Singapore - Frankfurt. Under the reciprocated arrangements, Qantas will code share on Iberia's daily services between Frankfurt and Madrid. Submissions about the variations are invited. Update

On 16 November 2007, the Commission issued Decisions [2007] IASC 214and [2007] IASC 215 varying the Determinations to permit Iberia Airlines to code share on Qantas servcies from Australia to Singapore and from Australia to Germany.


India

Qantas has applied for a variation to permit Jet Airways to code share on Qantas operated services on the India route. Submissions about the application are invited. Qantas application(Acrobat PDF 85KB) - advertised on 26 October 2007. The closing date for notifying an intention to make a submission is 2 November 2007, with submissions to be received by 9 November 2007.

Update

On 7 November 2007, the delegate of the Commission issued Decision [2007] IASC 212 permitting Jet Airways to code share on Qantas operated services.


South Africa

Qantas has applied to the Commission seeking an extention of an existing authorisation for Qantas and South African Airways (SAA) to code share on the Australia - South Africa route. Submissions are invited. Qantas application(Acrobat PDF330KB) - advertised on 12 October 2007. The closing date for notifying an intention to make a submission is 19 October 2007.

Solomon Islands

Pacific Blue has applied to the Commission for an allocation of 540 seats of capacity per week on the Solomon Islands route. Other applications for the capacity are invited. Pacific Blue application(Acrobat PDF 45KB) - advertised on 2 October 2007. The closing date for notifying an intention to make an application is 9 October 2007.

Other Applications

On 5 October 2007, Sky Air World(Acrobat PDF 161KB) submitted a notice of intention to apply for capacity. The application is due by COB 16 October 2007.

Update - 16 October 2007

Sky Air World's application for capacity together with the capacity sought by Pacific Blue is expected to exceed the amount of capacity available for allocation on the route. As a result the case is now a contested one. Accordingly the Commission has written to both applicants inviting them to address the paragraph 5 criteria in the Ministers policy statement by COB 19 October. The Commission has also advertised on 17 October 2007, inviting submissions from interested parties about the two applications. The closing date for notifying an intention to make a submission is 24 October 2007 and to make the submission is 31 October 2007.

19 October 2007 - Supplementary application for capacity

As part of its 19 October letter addressing the paragraph 5 criteria, Pacific Blue Australia modified its original application from 540 seats to 720 seats per week. See Pacific Blue Australia's paragraph 5 submission above for details. The application for the additional 180 seats was advertised on 24 October 2007. The closing date for other applications for this element of the capacity is 31 October 2007.

7 November 2007 - Letter from DOTARS

DOTARS wrote on 6 November 2007, in response to a request from the Commission, advising that it considered Sky Air World to be reasonably capable of obtaining the approvals necessary to operate.

21 November 2007 - Draft Determinations

The Commission has issued draft determinations proposing to allocate capacity to both Sky Air World and Pacific Blue Australia on the Solomon Islands route. The decision is in response to competing applications from the two airlines for capacity on the route. A copy of the Commission's draft determinations may be viewed here.

Submissions about the draft determinations are invited. Submissions must be received by no later than close of business on 27 November 2007. After consideration of any submissions, the Commission will issue its final determination/s as soon as possible.

Update - 19 December 2007

On 10 December 2007 the Commission issued final Determinations [2007] IASC 120and [2007] IASC 121 allocating 360 seats of capacity per week to Pacific Blue Australia and 470 seats of capacity per week to Sky Air World.


Indonesia

The IASC has received an application from Qantas to vary Determination [2003] IASC 203to permit seats to be sold under the Air France code on services between Denpasar and Sinagapore for the duration of the determination. Submissions about the application are invited. Qantas application(Acrobat PDF 139KB) - advertised on 27 September 2007. The closing date for notifying an intention of making a submission is 4 October 2007.

On 11 October 2007, the Delegate of the Commission issued Decision [2007] IASC 211 permitting Air France to code share on Qantas services.


Papua New Guinea

The IASC has received an application from Qantas Airways Limited (ACN 009 661 901) (Qantas) to vary Determination [2006] IASC 129 to enable Qantas to continue code sharing on Air Niugini services on the Papua New Guinea (PNG) route.

The application is in two parts. The first part seeks short term authorisation for code sharing until 29 February 2008. If approved by the IASC, this will allow code sharing to continue while the IASC conducts in parallel with the PNG Independent Competition and Consumer Commission (ICCC) an in depth review of arrangements. The second part of the Qantas application seeks code share authorisation for the duration of the Determination (30 June 2012) in the context of that broader review by the two Commissions. Air Niugini has separately sought authorisation from the ICCC to continue the code sharing arrangements with Qantas.

Submissions about the application are invited about the short and long term code share extensions. Qantas application
(Acrobat PDF785KB) - advertised on 18 May 2007. The IASC proposes to consider the short term extension only against the reasonably capable criteria (paragraph 4) in the Ministers policy statement. The Commission will additionally apply the broader Competition criteria (paragraph 5) in considering the longer term extension.

The closing date for notice of intention to make a submission about either proposal is COB 25 May 2007. After notification of intention, submitters have a further five working days to make a full submission about the short term proposal and an additional five days to submit about the long-term proposal, unless additional time is sought and agreed to by the Commission.

If no notice of intention is received by COB 25 May 2007, the Commission may proceed to decide the matters under consideration as soon as practicable after that date.

Update

On 30 May 2007, the Commission issued Decision [2007] IASC 208, which permits Qantas to continue to code share on Air Nuigini services until 29 February 2008.

Update 2 - 7 September 2007

The Commission has made a draft decision proposing to authorise a continuation of code sharing by Qantas with Air Niugini on Air Niugini's services between Sydney, Brisbane, Cairns and Port Moresby. The proposed period of authorisation is until 31 December 2009.

Submissions about the draft decision are invited. The closing date for the receipt of submission is COB 21 September 2007.

Update

On 16 November 2007, the Commission concluded its review of the code share arrangements between Qantas and Air Niugini. The Commission's final decision may be found here. The decision authorises a continuation of the code share arrangements until 31 December 2009. PNG's Independent Consumer and Competition Commission has also issued its final decision authorising a continuation of the arrangements for the same period, with some slightly different conditions.


Qantas has applied to the Commission to renew the following Determinations:

  • [2002] IASC 126, which allocates three frequencies per week with any aircraft on the Germany route, expires on 18 February 2008;
  • [2002] IASC 127, which allocates 229 seats per week on the Philippines route, expires on 02 April 2008;
  • [2002] IASC 129, which allocates seven third party code share services per week on the Thailand route, expires on 22 April 2008;
  • [2003] IASC 105, which allocates six B767-200 units of capacity per week in each direction on the Japan route, expires on 8 August 2008;
  • [2003] IASC 113, which allocates a total of 600 third country code share seats per week on the Italy route, expires on 10 August 2008;
  • [2003] IASC 112, which allocates 0.5 units of capacity per week in each direction on the French Polynesia route, expires on 7 September 2008;
  • [2003] IASC 107, which allocates 600 seats and three frequencies per week in each direction on the Hong Kong route, expires on 23 September 2008.
  • [2002] IASC 123, which allocates 240 seats weekly in each direction between Indonesia and any point in Australia and beyond Indonesia, 1600 seats weekly in each direction with four frequencies which may serve Denpasar, expires on 30 September 2008;
  • [2003] IASC 108, which allocates one frequency per week in each direction on the South Africa route, expires on 20 October 2008.
  • [2003] IASC 117, which allocates unlimited freight capacity and frequency in each direction on the China route, expiring on 23 October 2008;
  • [2003] IASC 121, which allocates unlimited all-cargo capacity and frequency on the United States route, expires on 30 October 2008;
  • [2003] IASC 120, which allocates unlimited capacity and frequency on the Singapore route other than all-cargo services, expires on 30 October 2008;
  • [2003] IASC 122, which allocates 200 third party code share seats per week on the Greece route, expires on 11 November 2008; and
  • [2002] IASC 124, which allocates 100 seats per week in each direction on the Vanuatu route, expires on 24 November 2008.

Pacific Blue Airlines has applied to the Commission to renew the following Determinations:

  • [2003] IASC 109, which allocates unlimited passenger and freight capacity on the New Zealand route, expires on 9 July 2008;
  • [2003] IASC 110, which allocates 1,260 seats of capacity in each direction on the Fiji route, expires on 9 July 2008; and
  • [2003] IASC 111, which allocates 720 seats of capacity per week on the Vanuatu route, expires on 9 July 2008.

Qantasand Pacific Blue Airlines applications were advertised on Thursday 6 September 2007.

Applications are invited for any of the capacity allocated by the determinations for which renewal is sought. The closing date for of intention to apply is COB 13 September 2007. After notification of intention to apply applicants have a further five working days to make a full application unless additional time is sought and agreed by the Commission.

If no notice of intention to apply is received by COB 13 September, the Commission may proceed to decide the matters under consideration as soon as practicable after that date.

Capiteq Limited, trading as Airnorth, applied to the Commission for a variation to an existing determination, which allocates unlimited capacity on the Indonesia route, to allow code sharing with Qantas on Airnorth's services between Darwin and Denpasar. Submissions about the application are invited. Airnorth's application is in two parts, part 1(Acrobat PDF58KB) and part 2(Acrobat PDF 26KB) - advertised on 13 August 2007. The closing date for notice of intention to make a submission is COB 19 August 2007.

On 31 August 2007, the Commission issued Decision [2007] IASC 210 permitting Qantas to code share on Airnorth's services.


Virgin Blue International Airlines (VBIA) have applied for an allocation of capacity on the South Pacific route. VBIA plans to operate ten B777-300 services per week from November 2008. To this end it has applied for capacity consistant with the terms of the Australia - United States air transport arrangements. Other applications are invited. VBIA application(Acrobat PDF202KB) - advertised on 5 July 2007. The closing date for notice of intention to make an application is COB 12 July 2007.

On 23 July 2007, the Commission issued Determination [2007] IASC 104 allocating capacity on the United States route to VBIA.


Qantas has applied to vary Determination [2006] IASC 110. Qantas seeks an additional third country code share service per week to enable an expansion of code sharing with Mal?Hungarian Airlines on the Thailand route. Update

On 13 June 2007, the Delegate of the Commission issued Decision [2007] IASC 209 enabling an expansion of Qantas' existing code share arrangements with Mal?Hungarian Airlines.


Qantas has applied for an allocation of 825 seats per week in each direction on the China route and to enable Jetstar, a wholly owned subsiduary of Qantas, to code share on Qantas operated services. On 13 June 2007, the Delegate of the Commission issued Determination [2007] IASC 103 allocating 835 seats per week on the China route.


HeavyLift Cargo Airlines Pty Ltd have applied for an allocation of 25,000kg of capacity on the Solomon Island route. Applications are invited. HeavyLift application(Acrobat PDF33KB ) - advertised on Tuesday 8 May 2007. The closing date for notice of intention to make an application is COB 15 May 2007.

Further Update

On 17 May 2007, the Commission issued Determination [2007] IASC 102 allocating 25 tonnes of freight capacity per week on the Solomon Islands route.


Qantas has applied for an allocation of three third country code share services per week in each direction on the Thailand route and to vary Determination [2006] IASC 110 to enable Malev to code share on Qantas operated services. Applications and submissions about the application are invited. Qantas application(Acrobat PDF127KB) - to be advertised on 27 March 2007. The closing date for notice of intention to make an application or a submission is COB 3 April 2007.

On 26 April 2007, the delegate of the Commission issued Decisions [2007] IASC 206and [2007] IASC 207 to permit Malev to code share on Qantas services for an allocation of three third country airline code share services per week on the Thailand route.

Update

On 14 March 2007 the Commission issued Decision [2007] IASC 204 to enable code sharing by Japan Airlines (JAL) on Jetstar services between Osaka and Brisbane/Sydney.


Qantas has applied for an allocation of 909 seats per week on the Malaysia route. Qantas application(Acrobat PDF54KB) - advertised on the 29 January 2007. The closing date for notice of intention to make an application is COB 2 February 2007.

On 9 February 2007, the Delegate of the Commission issued Determination [2007] IASC 101 allocating 909 seats per week on the Malaysia route.


Qantas has applied for a variation of a determination on the Canada route. The purpose of the application is to obtain an additional allocation of 36 seats each week on the Canada route. Closing date for giving notice of intention to apply and/or of intention to make a submission in relation to the applications for variations of existing determinations, is cob 23 January 2007.

Existing available capacity entitlements under the various air services arrangements are set out in the Register of Available Capacity.

On the 29 January 2007, the Delegate of the Commission issued Decision [2007] IASC 202 which allocated an additional 36 seats per week in each direction on the Canada route.


Commission's Procedures and Requirements

The Commission has published procedures for making determinations allocating available capacity and for reviewing existing determinations. The procedures are designed to be consistent with the requirements of the legislation and with the principles of natural justice. They are intended to give applicants and other interested parties procedural fairness, ensure that the Commission's processes are as open as possible, and provide guidance to anyone wishing to apply for, or make submissions about, an allocation of air route capacity.

Email Notification

The Commission provides an email notification service for interested parties. The full version includes copies of applications, determinations and decisions in Acrobat format. A shorter version of this service is an email notification of new applications, determinations or decisions. If you require either version of the email notification, please send an email to IASC@infrastructure.gov.au indicating the version you would like to receive and an indication of your interest and/or organisation.

The Commission maintains a Register of Public Documents for all applications. Copies of virtually all documents placed on the Register are available by email from the Commission for an annual charge of $250 (from 1 July 2000).
