Cases Completed in 2012

Below is a list of the Commission's completed cases in 2012.

Japan - 27 November 2012

The Commission has received an application [PDFPDF: 349 KB] [docReader icon] from Qantas for a variation of various Determinations to permit Japan Airlines to code share on Jetstar Airways services between Australia and Japan until 30 June 2017. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB (ie. 5pm) on 4 December 2012, with the submission due by COB 11 December 2012. If no notice of intention is received by COB 4 December 2012, the Commission may proceed to make a decision.

Update - 24 December 2012

On 24 December 2012 the Commission issued Decision [2012] IASC 220 [PDFPDF: 98 KB] [docReader icon] permitting Jetstar and Japan Airlines to continue to code share on the Japan route until 30 June 2017.

South Africa - 05 July 2012

The Commission has received an application [PDFPDF: 49 KB] [docReader icon] from Qantas seeking a new determination for a total of 7 frequencies per week in each direction on the South Africa route. This is intended to replace the determinations currently held on the route. Qantas is also applying for the new determination to include a condition to permit SAA to code share on Qantas services until 31 March 2016. Other applications for the capacity and submissions about the code share are invited. The closing date for notice of intention to make an application is COB (i.e. 5pm) on 12 July 2012, with applications due by COB 19 July 2012. If no notice of intention is received by COB 12 July 2012, the Commission may proceed to make a decision.

Update - 10 July 2012

Qantas did not state in its application the period for which it was seeking a new determination allocating it 7 frequencies per week. Qantas has now confirmed that it is seeking the determination for a 5 year term from the date the determination is made.

Update - 17 September 2012

On 14 September 2012 the Commission issued Draft Determination [2012] IASC 106d [PDFPDF: 1258 KB] [docReader icon] proposing to allocate to Qantas seven services per week on the South Africa route and to permit South African Airways to code share on Qantas services until 31 December 2014.

The Commission invites submissions about the Draft Determination. The closing date for notice of intention to make a submission is COB (i.e. 5pm) on 24 September 2012, with submissions due by COB 1 October 2012. If no notice of intention is received by COB 24 September 2012, the Commission may proceed to make a decision.

Update - 20 November 2012

On 19 November 2012 the Commission issued Determination [2012] IASC 106 allocating seven services per week on the South Africa route. The Determination also permits South African Airways to code share on Qantas' services until 31 December 2014, subject to conditions. United Arab Emirates - 04 October 2012

The Commission has received an application [PDFPDF: 72 KB] [docReader icon] from Qantas for an allocation of fourteen frequencies per week on the United Arab Emirates route. Qantas plans to operate daily services from both Sydney and Melbourne to London, via Dubai. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB (i.e. 5pm) on 11 October 2012, with the application due by COB 18 October 2012. If no notice of intention is received by COB 11 October 2012, the Commission may proceed to make a decision.

Update - 14 November 2012

On 14 November 2012 the Delegate, on behalf of the Commission, issued Determination [2012] IASC 107 [PDFPDF: 192 KB] [docReader icon], allocating 14 frequencies per week to Qantas.

Indonesia - 25 September 2012

The Commission has received an application [PDFPDF: 277 KB] [docReader icon] from Virgin Australia for a variation to Determination [2009] IASC 113 to permit Delta to code share on Virgin Australia services. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB (ie 5pm) on 2 October 2012, with the submission due by COB 9 October 2012. If no notice of intention is received by COB 2 October 2012, the Commission may proceed to make a decision.

On 13 November 2012 the Delegate, on behalf of the Commission issued Decision [2012] IASC 218 [PDFPDF: 1027 KB] [docReader icon] varying Determination [2009] IASC 113, as requested, to permit Delta to code share on Virgin Australia services.

New Zealand - 25 September 2012

The Commission has received an application [PDFPDF: 285 KB] [docReader icon] from Virgin Australia for a variation to Determination [2007] IASC 118 to permit Singapore Airlines to code share on Virgin Australia services. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB (ie 5pm) on 2 October 2012, with the submission due by COB 9 October 2012. If no notice of intention is received by COB 2 October 2012, the Commission may proceed to make a decision.

Netherlands - 26 June 2012

The Commission has received an application [PDFPDF: 260 KB] [docReader icon] from Virgin Australia seeking an allocation of 400 seats of passenger capacity per week on the Netherlands route. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB (ie 5pm) on 3 July 2012, with applications due by COB 10 July 2012. If no notice of intention is received by COB 3 July 2012, the Commission may proceed to make a decision.

On 12 July 2012 the Commission issued Determination [2012] IASC 105 [PDFPDF: 128 KB] [docReader icon] allocating the 400 seats of capacity per week to Virgin Australia.

France - 26 June 2012

The Commission has received from Virgin Australia an application [PDFPDF: 296 KB] [docReader icon] for a variation to Determination [2010] IASC120 to permit Singapore Airlines to code share on Virgin Australia services. Submissions about the application are invited.

The closing date for notice of intention to make a submission is COB (ie 5pm) on 3 July 2012, with the submission due by COB 10 July 2012. If no notice of intention is received by COB 3 July 2012, the Commission may proceed to make a decision.

South Africa - 21 June 2012

The Commission has received an application [PDFPDF: 108 KB] [docReader icon] from Qantas seeking an interim authorisation to continue the current code share between South African Airways and Qantas.

The closing date for notice of intention to make a submission is COB (ie 5pm) on 28 June 2012, with the submission due by COB 5 July 2012. If no notice of intention is received by COB 28 June 2012, the Commission may proceed to make a decision.

On 12 July 2012 the Commission issued Decision [2012] IASC 216 [PDFPDF: 147 KB] [docReader icon] permitting South African Airways to code share on Qantas services until 31 march 2013.

Papua New Guinea - 01 March 2012

The Commission has received an application [PDFPDF: 371 KB] [docReader icon] from Qantas seeking to extend the authorisations permitting it to code share with Air Niugini on the Papua New Guinea route. Submissions about this application are invited.

The closing date for notice of intention to make a submission is COB (ie 5pm) on 8 March 2012, with the submission due by COB 15 March 2012. If no notice of intention is received by COB 8 March 2012, the Commission may proceed to make a decision.

Update - 28 June 2012

On 28 June 2012 the Commission issued Decision [2012] IASC 215 [PDFPDF: 9836 KB] [docReader icon], varying Determination [2011] IASC 132 to permit Air Niugini to code share on Qantas services until 30 June 2017.

Bangladesh and Thailand - 12 April 2012

As part of the Capacity Utilisation reporting process, Virgin Australia have applied [PDFPDF: 215 KB] [docReader icon] to the Commission for a variation to determinations on two routes.

On the Bangladesh route Virgin Australia have applied to vary Determination [2011] IASC 122 to remove provisions for Etihad Airways to code share on Virgin Australia International Airlines services and add provisions to provide joint services with Singapore Airlines.

On the Thailand route Virgin Australia have applied to vary Determination [2010] IASC 119 to remove provisions for Etihad Airways to code share on Virgin Australia International Airlines services and add provisions to provide joint services with Singapore Airlines.

The closing date for notice of intention to make a submission is COB (ie 5pm) on 19 April 2012, with the submission due by COB 26 April 2012. If no notice of intention is received by COB 19 April 2012, the Commission may proceed to make a decision.

On 11 May 2012 the Commission issued Decisions [2012] IASC 211 [PDFPDF: 1683 KB] [docReader icon] and [2012] IASC 213 [PDFPDF: 1699 KB] [docReader icon] permitting provision of joint services with Singapore Airways on the Bangladesh and Thailand routes.

Japan - 09 March 2012

The Commission has received an application [PDFPDF: 28 KB] [docReader icon] from Qantas seeking a variation of [2012] IASC 102 to permit Japan Airlines to code share on Jetstar services. Submissions about this application are invited.

The closing date for notice of intention to make a submission is COB (ie 5pm) on 16 March 2012, with the submission due by COB 23 March 2012. If no notice of intention is received by COB 16 March 2012, the Commission may proceed to make a decision.

Taiwan - 06 March 2012

The Commission has received an application [PDFPDF: 74 KB] [docReader icon] from Virgin Australia seeking an allocation of 1,000 seats per week on the Taiwan route to facilitate plans to code share on Singapore Airlines services on the Australia-Singapore-Taipei route. Other applications for the capacity are invited.

The closing date for notice of intention to make an application is COB (ie 5pm) 13 March 2012, with the application due by COB 20 March 2012. If no notice of intention is received by COB 13 March 2012, the Commission may proceed to make a determination.

On 29 March 2012, the Commission issued Determination [2012] IASC 104 [PDFPDF: 166 KB] [docReader icon] allocating 1,000 seats of capacity in each direction on the Taiwan route to Virgin Australia.

Indonesia - 28 February 2012

The Commission has received an application [PDFPDF: 65 KB] [docReader icon] from Virgin Australia seeking to transfer the 8,560 seats of capacity currently held by Virgin Australia Airlines to Virgin Australia International Airlines. Submissions about this application are invited.

The closing date for notice of intention to make a submission is COB (ie 5pm) on 6 March 2012, with the submission due by COB 13 March 2012. If no notice of intention is received by COB 6 March 2012, the Commission may proceed to make a decision.

Update 29 March 2012

On 29 March 2012, the Commission issued Decision [2012] IASC 204 [PDFPDF: 202 KB] [docReader icon], transferring capacity allocated by Determinations [2008] IASC 120, [2009] IASC 103, [2009] IASC 105, [2009] IASC 113, [2010] IASC 109 and [2011] IASC 110 from Virgin Australia to Virgin Australia International.

Japan - 13 February 2012

The closing date for notice of intention to make an application is COB (ie 5pm) 20 February 2012, with the application due by COB 27 February 2012. If no notice of intention is received by COB 20 February 2012, the Commission may proceed to make a determination.

On 23 February 2012, the delegate, on behalf of the Commission, issued Determination [2012] IASC 102 [PDFPDF: 141 KB] [docReader icon] allocating unlimited capacity to points in Japan other than Narita and Haneda Airports as requested.
