The International Air Services Commission (the Commission) has received an application [PDF: 45 KB] from Qantas seeking a new determination on the China route effectively consolidating its multiple determinations on the route. Qantas is applying for a fresh allocation of 4,471 seats (the same number that it currently holds in total on the route) and will seek to revoke its existing determinations within 10 working days from the date of issue of the new determination.
Qantas is also seeking the inclusion of the following conditions:
- the determination is for a period of five years from the date of issue;
- the capacity will be fully utilised by 30 April 2017;
- the capacity may be utilised by Qantas or another Australian carrier which is a wholly-owned subsidiary of Qantas;
- the capacity may be used by Qantas to provide joint services with any wholly-owned subsidiary and by any wholly-owned subsidiary of the Qantas Group to provide joint services with Qantas;
- the capacity may be used by Qantas to provide services jointly with China Eastern.
As not all of the above conditions are included in the existing determinations sought to be consolidated, Qantas is effectively seeking a variation.
Invitation for other applications and submissions
In accordance with sections 12 and 22 of the International Air Services Commission Act 1992, the Commission invites other applications and submissions on the Qantas application.
The closing date for making an application or submission is 27 April 2016, Wednesday.
If you are intending to make an application or submission, please inform, by email, the Executive Director of the Commission of your intention to make an application/ submission as soon as practicable.
On 9 May 2016, the Commission issued Determination  IASC 102 [PDF: 1682 KB] in favour of Qantas allocating 4,471 seats of capacity per week in each direction on the China route. The new Determination replaces  IASC 113 and  IASC 125 which Qantas is required to revoke within 10 working days of the issue of the new Determination. The capacity may be utilised by either Qantas or another Australian carrier which is a wholly-owned subsidiary of Qantas. Qantas is also permitted to utilise the capacity for code share services with China Eastern. The capacity is required to be fully utilised by no later than 30 April 2017.
