1 The application

1.1    On 5 October 2023, the International Air Services Commission (the Commission) received email correspondence from Worrells, applying on behalf of Pacific Air Express, to revoke, pursuant to section 27AA of the International Air Services Act 1992 (the Act), the following determinations:

  • [2013] IASC 136 allocating 17.5 tonnes of freight capacity on the Vanuatu route;
  • [2020] IASC 102 allocating17.5 tonnes of freight capacity on the Papua New Guinea route;
  • [2019] IASC 117 allocating17.5 tonnes of freight capacity on the Papua New Guinea route;
  • [2019] IASC 104 allocating17.5 tonnes of freight capacity on the Papua New Guinea route;
  • [2019] IASC 127 allocating unlimited freight capacity on the Hong Kong route,
  • [2017] IASC 109 allocating unlimited freight capacity on the Nauru route; and
  • [2017] IASC 111 allocating unlimited freight capacity on the China route.

 2 Commission's consideration

2.1    In accordance with section 27AB of the Act, the Delegate of the Commission may consider the application by Worrells on behalf of Pacific Air Express. For the purposes of this instrument, all references to the Commission include the Delegate of the Commission.

2.2    Under subsection 27AA(1) of the Act, an Australian carrier, to whom a determination allocating capacity is issued, may at any time request the Commission to revoke a determination. In this instance, the carrier has gone into external administration and Worrells is making the request on behalf of the carrier, Pacific Air Express.

2.3    Pursuant to subsection 27AA(3), the Commission must make a decision revoking the determinations as requested.

3   Decision [2023] IASC 210

3.1    In accordance with section 27AA of the Act, the Delegate, on behalf of the Commission, revokes Determinations [2013] IASC 136, [2017] IASC 109, [2017] IASC 111, [2019] IASC 104, [2019] IASC 117, [2019] IASC 127 and [2020] IASC 102 with effect from the date this instrument is made.
