1 The application
1.1 On 2 November 2020, as part of its capacity utilisation report, Virgin Australia applied to the Commission to revoke all its existing determinations on the Cook Islands, Hong Kong and Papua New Guinea routes. Virgin Australia’s applications are in accordance with section 27AA of the International Air Services Commission Act 1992 (the Act).
2 Commission's consideration
2.1 On 6 February 2020, Virgin Australia announced the withdrawal of its services to Hong Kong. The Melbourne-Hong Kong services were suspended with effect from 11 February 2020 while the Sydney-Hong Kong services ceased operating from 2 March 2020.
2.2 Under subsection 27AA(1) of the Act, an Australian carrier, to whom a determination allocating capacity is issued, may at any time request the Commission to revoke the determination.
2.3 Upon receipt of an application to revoke a determination, the Commission must make a decision revoking the determination pursuant to subsection 27AA(3).
3 Decision [2020] IASC 214
3.1 In accordance with section 27AA of the Act, the Commission revokes Determination [2016] IASC 107 with effect from the date this instrument is made.
